This Privacy Notice (the ‘Notice’) outlines how Bitwise Asset Management, Inc. and its affiliates and subsidiaries (‘Bitwise’, ‘we’, ‘us’ or ‘our’) collect, use, disclose and protect personal information obtained through their websites and, where applicable, any online services they provide. This Notice applies to all entities within the Bitwise group, including our US, Cayman Islands, Guernsey, Switzerland and EU/UK subsidiaries and any other relevant location, and includes, following its acquisition by Bitwise Asset Management, Inc., Bitwise Onchain Solutions AG (Zug, Switzerland).
Where provisions of this Notice apply only to specific Bitwise entities or websites, this is indicated as follows:
Bitwise Asset Management and Bitwise Onchain Solutions denotes provisions that apply exclusively to Bitwise Asset Management, Inc., Bitwise Onchain Solutions Limited and Bitwise Onchain Solutions AG, and their respective products and services. Bitwise Onchain Solutions AG (Zug, Switzerland) and Attestant BVI Limited (British Virgin Islands) provide blockchain infrastructure, staking, and validator node services within the Bitwise Onchain Solutions group. Where those services involve the processing of personal data, the relevant entity processes such data in its capacity as a data controller, independently or jointly with other Bitwise entities as applicable. References to ‘Bitwise Onchain Solutions’ in this Notice refer collectively to those entities.
Bitwise Europe denotes provisions that apply exclusively to Bitwise Europe and the bitwiseinvestments.eu website. For the purposes of this Notice, ‘Bitwise Europe’ refers collectively to Bitwise Europe GmbH (Frankfurt am Main, Germany), Bitwise Europe Limited (Guernsey, Channel Islands), and Bitwise Europe Management Limited (London, United Kingdom), each of which may act as an independent or joint data controller in respect of the processing activities described in this Notice.
All other provisions apply across the Bitwise group as a whole.
Bitwise Asset Management and Bitwise Onchain Solutions This Notice is incorporated by reference into the Bitwise Terms of Service (the ‘Terms’). Any defined terms used and not defined herein shall have the meanings given to such terms in the Terms.
Bitwise Europe For the purposes of this Notice, references to the ‘Service’ in respect of Bitwise Europe mean the Bitwise Europe website at bitwiseinvestments.eu (the ‘Site’). This Notice is incorporated by reference into the Bitwise Europe Terms of Website Use.
Bitwise Asset Management, Inc. and its subsidiaries and affiliates each act as data controllers for the personal information they collect and process. Where specific processing activities involve the joint determination of purposes and means by two or more Bitwise entities – in particular in the context of centralised functions operated by the parent company – the relevant entities act as joint controllers in accordance with Article 26 of the EU and UK General Data Protection Regulation (‘GDPR’), Section 33 of the Data Protection (Bailiwick of Guernsey) Law 2017 (‘Guernsey GDPR’), and as jointly responsible controllers under the Swiss Federal Act on Data Protection (‘FADP’) and the Swiss Data Protection Ordinance, as applicable. In such cases, the roles and responsibilities of each entity are governed by a separate Joint Controller Arrangement (‘JCA’). The substance of this arrangement is available upon request by contacting us using the details set out in Section 22 below.
For purposes of this Notice, ‘personal information’ includes information that may be referred to as ‘personal data’ under certain applicable laws.
Bitwise Asset Management, Inc. provides centralised privacy governance, policies, and tools for the Bitwise group. However, each entity within the group is responsible for ensuring its own compliance with applicable privacy laws and fulfilling its own obligations as a data controller.

Bitwise Asset Management and Bitwise Onchain Solutions This includes identity verification and onboarding platform providers.
Bitwise Europe When you visit the Site, we and our third-party service providers receive and record information on our server logs from your browser, including your IP address, and from cookies and similar technology.
Our service providers may collect information about your online activities over time and across different online services.
We work with analytics providers who may use cookies and similar technologies to collect and analyse information about the use of the Service and report on activities and trends. These providers may also collect information regarding the use of other websites, apps, and online resources. One of the service providers that we use for data analytics is Google Analytics.
For additional information please see Section 13 (Cookies and Tracking Technologies).
The following categories of personal data may be collected and processed by Bitwise entities in connection with the provision of the Service:
Usage statistics collected through Google Analytics 4 (GA4) and our server-side event log (ga-targets.js) involve the processing of personal data, including IP addresses and client identifiers. Where technically possible, IP addresses are stored in masked form only. Cookies and tracking are activated only after you have given your consent. These data are processed on the legal bases set out in Section 4 and subject to the retention periods in Section 8.
Bitwise Asset Management and Bitwise Onchain Solutions Where we process data relating to criminal offences or PEP status, we do so only to the extent required by, and under the authority of, applicable anti-money laundering and financial services legislation. We use personal information (including but not limited to) to:
Bitwise Asset Management and Bitwise Onchain Solutions
Bitwise Europe
Depending on your location and the nature of our relationship with you, we process your personal data on one or more of the following grounds:
Each Bitwise entity is responsible for identifying and documenting its own legal basis for processing, as required by applicable law.
Intra-Group and Third-Party Data Sharing
To facilitate our global operations, personal information may be shared among Bitwise entities, where permitted by applicable law and depending on the relationship and services involved. This sharing is conducted in accordance with applicable data protection laws and our internal policies to ensure adequate protection of your personal information.
Where Bitwise entities act as joint controllers for specific processing activities, they have put in place a Joint Controller Arrangement (JCA) which allocates responsibilities between the parties, in particular as regards the handling of data subject rights requests, breach notification, and the maintenance of a valid legal basis for processing. The substance of this arrangement is available upon request by contacting us using the details set out in Section 22 below.
For US customers of Bitwise Asset Management, Inc., our information-sharing practices (including any sharing with affiliates) are described in our Annual Privacy Notice, which will control in the event of any inconsistency.
Bitwise Asset Management and Bitwise Onchain Solutions

Bitwise Europe
In connection with the operation of the Site, personal data may be shared with or received by the following third-party service providers acting as data processors on our behalf:
We ensure that all third-party service providers who process personal data on our behalf are subject to appropriate contractual arrangements consistent with applicable data protection law.
International Data Transfers
Where we transfer personal data from the EU, UK, Guernsey or Switzerland to the United States (i.e. to Bitwise Asset Management, Inc.), such transfers are carried out on the basis of Standard Contractual Clauses adopted by the European Commission (Commission Implementing Decision (EU) 2021/914). The applicable module depends on the nature of the processing activity: where Bitwise Asset Management, Inc. acts as an independent data controller in respect of the relevant data, Module 1 (controller-to-controller) applies; where Bitwise Asset Management, Inc. processes data solely on our instructions, Module 2 (controller-to-processor) applies.
The applicable transfer mechanism depends on the jurisdiction from which data is transferred:
Where Bitwise Asset Management, Inc. processes personal data solely on the instructions of and on behalf of Bitwise Europe Limited or another Bitwise Europe group entity or a Bitwise Onchain Solutions entity (for example, in connection with the operation of shared infrastructure or group-wide systems), such transfers are carried out on the basis of Standard Contractual Clauses, Module 2 (controller-to-processor), as supplemented where applicable by the transfer addenda set out above.
Bitwise Asset Management, Inc. is currently not registered under the EU-US Data Privacy Framework.
Transfers of personal data from Bitwise Asset Management, Inc. to its subsidiaries are made in accordance with data minimisation and access control principles. Where required by applicable law, equivalent safeguards apply to such onward transfers.
Data flows between EU, UK, Guernsey and Swiss entities are governed by the applicable data protection frameworks (EU GDPR, UK GDPR, Guernsey GDPR, and the Swiss FADP and Data Protection Ordinance respectively).
You may request access to, or a copy of, the relevant transfer safeguards by contacting us using the details set out in Section 22 below.
Transfers to third-party service providers
Where personal data is transferred to recipients located outside the United Kingdom, European Economic Area, or Switzerland, Bitwise relies on the following transfer mechanisms to ensure that such transfers are carried out in accordance with applicable data protection law.
You can verify current certifications under the EU-US Data Privacy Framework at www.dataprivacyframework.gov. Copies of any Standard Contractual Clauses relied upon by Bitwise are available upon request by contacting us using the details set out in Section 22 below.
We use reasonable technical, administrative, and physical measures to protect personal information contained in our systems against unauthorised access, destruction, misuse, loss, or alteration. Our security measures include, amongst other things:
Bitwise Asset Management, Inc. holds ISO 27001 certification for information security management, reflecting our commitment to maintaining a robust security posture.
No method of transmission over the internet or method of electronic storage can be guaranteed to be 100% secure. We cannot ensure or warrant the security of any information you provide to us.
In the event of a personal data breach likely to result in a risk to your rights and freedoms, we will notify the competent supervisory authority without undue delay and, where required under applicable law, will also notify affected data subjects, in accordance with our obligations under applicable data protection law.
By using the Service or providing information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Service. You may have a legal right to receive such notice in writing. To receive free written notice of a security breach (or to withdraw your consent to receiving electronic notice), please contact us using the details provided in Section 22 below.
We retain personal information for as long as reasonably necessary to fulfil the purposes outlined in this Notice, comply with our legal obligations, resolve disputes, and enforce our agreements. Retention periods are based on our Group Data Retention Policy and vary depending on the type of information and the context in which it is processed.
Individual legal, regulatory, or contractual obligations applicable to each group entity may require adjustment to these periods. Where multiple retention requirements apply, the longest applicable period shall prevail.
We may access, preserve, use, and disclose your information where required or permitted by applicable law, or where we reasonably believe such action is necessary to: (i) comply with applicable law, legal process, or legally binding requests from public authorities; (ii) enforce our agreements, terms, or policies; (iii) respond to your requests; or (iv) protect the rights, property, or safety of you, us, or others.
If we are involved in a merger, acquisition, investment, financing, reorganisation, bankruptcy, sale of assets, or other corporate transaction, your personal information may be disclosed or transferred to the relevant successor entity or prospective purchaser where permitted by applicable law. Such entity will process your personal information in accordance with this Privacy Notice or will provide you with notice of any material changes where required by applicable law.
We may also share your personal information within our corporate group for internal administrative, compliance, operational, and other legitimate business purposes, where permitted by applicable law. For US customers of Bitwise Asset Management, Inc., such disclosures are also subject to our Annual Privacy Notice.
We may also disclose your information with your permission.
We do not share your personal information with third parties for their own direct marketing purposes. Where you have chosen to receive marketing communications from us, we may send you information about Bitwise’s products, services, events, and updates, including, where separate consent has been obtained from you, information about products and services offered by companies within the Bitwise group. You may withdraw your consent at any time (where marketing is based on your consent) or otherwise opt out of receiving marketing communications by using the unsubscribe link included in our marketing emails or by contacting us using the contact details provided in Section 22 of this Notice. Withdrawal of your consent will not affect the lawfulness of processing carried out before the withdrawal.
We use cookies, tracking pixels and similar technologies on our websites, services and, where applicable and you have explicitly consented, in emails we send to you. These technologies may be used for essential functionality, security and strictly necessary service delivery, as well as for analytics, measuring email delivery or engagement, personalisation, advertising and marketing.
Where consent is required by applicable law, we will not use non-essential technologies – including tracking pixels used to measure individual email opens or engagement, personalise communications, profile recipients, or support advertising or marketing – unless you have first provided valid consent. You may refuse or withdraw that consent at any time without losing access to the Service or, where applicable, without stopping the underlying emails.
You can manage website technologies through the Cookie Settings on the relevant Bitwise website. Where an email contains tracking technologies, information about those technologies and a means of managing or withdrawing your tracking preference will be provided when your email address is collected and/or through a clearly accessible link in the email. Browser or email-client settings may also restrict certain technologies but may not provide complete control.
Further information – including the technologies used, their purposes and applicable legal bases – is provided in the Cookie Policy.
Some web browsers offer a ‘Do Not Track’ (DNT) feature. Because there is no universally adopted standard requiring websites to respond to DNT signals, our websites do not currently respond to such signals. Where applicable law requires us to recognise or honour other browser-based privacy preference signals, we will do so in accordance with those legal requirements. We remain committed to respecting your privacy and complying with applicable data protection laws.
We may anonymise personal information that we collect so that the resulting information no longer identifies, and cannot reasonably be used to identify, you or any other individual. We may also aggregate information for statistical and analytical purposes.
We may use anonymised and aggregated information for purposes including testing and improving our IT systems, research, data analysis, improving the Service and our products and services, and developing new products, services, and features.
We may also disclose or share anonymised and aggregated information with third parties, provided that such information does not identify, and cannot reasonably be used to identify, any individual.
Our website and Service are not directed to children, and we do not knowingly collect personal information from children where such collection is restricted by applicable law, including children under the age of 13 in the United States and children below the applicable age of digital consent in jurisdictions where such restrictions apply.
If we become aware that we have collected personal information from a child without any required consent or other valid legal basis, we will take reasonable steps to delete such information as soon as reasonably practicable, unless we are required by applicable law to retain it. If you believe that a child has provided us with personal information, please contact us using the contact details provided in this Notice so that we can investigate and, where appropriate, delete the information in accordance with applicable law.
Our Service is accessible globally. We are committed to protecting your personal data in accordance with applicable data protection laws and the principles described in this Notice.
Where the laws of your jurisdiction provide you with additional rights, impose specific obligations, or require additional notices, we will comply with those requirements as applicable.
We may update this Notice from time to time to reflect changes to our practices, services, legal requirements, or other operational needs. Any updates will be posted on this page with a revised ‘Last updated’ date.
Where required by applicable law, we will provide additional notice of material changes, including where such changes significantly affect how we collect, use, disclose, or otherwise process your personal data.
We encourage you to review this Notice periodically to stay informed about how we protect your personal data.
Our Service may contain links to, or allow third parties to link to, websites or services that are operated independently from us. We do not control and are not responsible for the content, security, or privacy practices of such third-party websites or services.
Any personal information you provide to a third party will be processed in accordance with that third party’s privacy notice and applicable terms. We encourage you to review the privacy notice of any third-party website or service before submitting personal information.
Depending on your location and applicable law, you may have certain rights in relation to your personal information. The rights available to you may vary by jurisdiction and by the context in which we process your information. Examples of rights that may be available (subject to applicable conditions, exceptions, and limitations) include:
These rights are subject to conditions, exceptions, limitations, and verification requirements under applicable law. We may need to verify your identity and/or authority before responding to your request.
